By accessing or using GamePromptKit ("the Service") at gamepromptkit.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Description of Service

GamePromptKit is a subscription-based platform providing a curated library of AI prompts designed for indie game developers. Prompts are intended to be used with third-party AI tools including ChatGPT, Claude, Midjourney, and others. We do not operate those AI tools and are not responsible for their outputs.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account with others or use another person's account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

• Paid subscriptions are billed in advance on a monthly basis.
• The Lifetime plan is a one-time payment with no recurring charges.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• We offer a 7-day refund policy for new subscriptions. Contact us within 7 days of purchase for a full refund.
• Prices are subject to change with 30 days' notice to existing subscribers.

5. Permitted Use

You may use GamePromptKit prompts to:

• Generate content for your personal or commercial game development projects
• Use with any AI tool of your choice
• Modify and adapt prompts for your specific needs

You may not:

• Resell, redistribute, or sublicense the prompt library itself
• Scrape, copy, or republish the prompt library in bulk
• Share your account login with others to circumvent subscription limits
• Use the Service to build a competing prompt library product

6. Intellectual Property

The GamePromptKit prompt library, website design, and branding are owned by GamePromptKit. You retain ownership of any content you create using our prompts. We claim no rights over the outputs you generate using our prompts with third-party AI tools.

7. Disclaimer of Warranties

GamePromptKit is provided "as is" without warranties of any kind. We do not guarantee that prompts will produce specific results when used with any AI tool, as AI outputs vary based on the tool, model version, and other factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, GamePromptKit shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to GamePromptKit at any time if you violate these terms. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the Service after changes take effect constitutes your acceptance of the revised terms.

11. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of GamePromptKit shall be resolved through good-faith negotiation before any legal proceedings.
